Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its 44th Annual Institute, June 18-20, 2023.

Litigation Attorneys Katrina Bowers, Josh Snyder and Austin Rogers will present “Devil’s Advocate: Crossing the Line of Zealous Advocacy.” As zealous advocates, attorneys dance on the blade of aggressive advocacy and persuasion.  This presentation will explore this delicate dance through the lens of real-life examples.

Pipeline Attorney Keith Coyle will present “New Federal Gathering Line Regulations.” The Pipeline and Hazardous Materials Safety Administration issued a final rule in November 2021 prescribing new safety standards and reporting requirements for onshore gas gathering lines.  In this session, Keith, a former PHMSA Attorney Advisor who represented two pipeline trade organizations during the rulemaking process and in subsequent litigation, will provide an overview of the new requirements.  As part of his discussion, he will review the criteria that determine whether an onshore gas gathering line meets the definition of a newly regulated Type C gathering line, as well as the regulatory requirements that apply to these types of pipelines.  Keith will also cover the requirements that apply to reporting-only Type R gathering lines and some of the other key provisions in the new rules, including the process for obtaining authorization to use composite pipe material in Type C lines.
